The Probate Process

Probate is the legal process of administering a person’s estate after their death. Generally, your estate must pass through probate regardless of whether or not you have a Will. If you have a Will, the judge will review it to ensure it is valid, then the estate executor will administer your estate according to the instructions in your Will. If you do not have a Will, the court will follow state intestacy laws.

The probate process typically involves:

  • Appointing a personal representative to handle the probate process
  • Taking an inventory of the deceased person’s assets
  • Notifying beneficiaries, heirs, and creditors
  • Filing an inventory and accounting
  • Paying the deceased person’s debts and taxes
  • Transferring title of the deceased person’s property
  • Filing documents to close the estate

Our probate lawyers can answer your questions and guide you through the entire probate process.

Probate litigation occurs when family members, heirs, beneficiaries, and other relatives disagree about how a loved one’s estate is being handled. Common claims our probate lawyers handle include:
